Agreement

These Terms of Service (“Terms”) govern your use of https://floridaspringskayaking.com, your rental of clear kayaks and paddleboards from Florida Springs Kayaking, and the Florida Springs Kayaking SMS Alerts Program. By using this website, completing a booking, or opting in to text messages, you agree to these Terms and to our Privacy Policy.

If anything on the booking page or in a signed waiver differs from this page for a specific reservation, the checkout terms and waiver for that reservation control.

Who we are

Florida Springs Kayaking provides clear kayak and paddleboard rentals on the Silver River at Silver Springs State Park (Silver Springs / Ocala, Florida) and on the Rainbow River near Dunnellon, Florida. Call (954) 851-4785. This page is public and does not require a login.

Bookings and payment

Reservations are made through our FareHarbor booking page at dates and prices, or by phone. The rate, trip length, start time, equipment choices, weight or age limits shown for that rental, park-fee notes, cancellation, refund, late-arrival, and weather terms are displayed before you pay. Those checkout terms form part of your booking.

Park admission, parking, or other gate fees charged by a state park or launch are separate from the rental unless the booking page says otherwise. You are responsible for arriving on time and for following the meeting instructions given after you book.

We may cancel or move an outing when weather, water conditions, equipment, or park rules make it unsafe or impractical. If we cancel, we will work with you on a new time or a refund according to the terms shown at checkout.

Rentals, safety, and the rivers

Kayaking and paddleboarding are outdoor water activities. They involve risk of injury, drowning, property damage, wildlife encounters, weather, and other hazards. You paddle at your own risk. By launching, you confirm that you and everyone in your group can swim or will wear a life jacket as instructed, will listen to the launch briefing, and will use the equipment as intended.

• Life jackets and a launch briefing are part of the setup. Wear and follow what we provide.
• Stay with your craft, follow park and river rules, and give wildlife plenty of room. Do not feed or chase animals.
• You are responsible for the boats, boards, and gear in your care until they are returned. You may be charged for loss or damage beyond ordinary wear.
• We may refuse or end a rental if a guest appears impaired, ignores safety instructions, or puts others at risk.
• Minimum ages, weight limits, and whether a child must ride with an adult are stated on the booking page for each rental.

Wildlife sightings are never guaranteed. Silver Springs is generally a stay-in-your-craft paddle; swimming rules on Rainbow River depend on the day and the park. Ask before you book if a swim is part of your plan.

Photos and reviews

We may photograph or film the rivers and our outings for our website and social channels. If you prefer not to appear, tell us at the launch. Reviews you post publicly may be quoted on this site.

SMS / text messaging program

Florida Springs Kayaking SMS Alerts Program: booking confirmations, reservation reminders, schedule or weather updates about your rental, customer-care replies, and, if you opt in on the contact form, occasional offers. We send these messages to guests who provide a mobile number when they book or check the SMS box on the contact form.

Opt-in. You opt in by checking the optional, unchecked SMS box on our contact form at https://floridaspringskayaking.com/contact, by providing your mobile number when you complete a reservation on our FareHarbor booking page (transactional messages about that booking), by requesting texts when you call (954) 851-4785, or by texting START after a prior opt-out. Marketing texts are sent only if you check the SMS box. Consent to receive text messages is not a condition of purchase or of sending the contact form.

Opt-Out. You can cancel the SMS service at any time. Just text “STOP” to the number that messaged you, or to (954) 851-4785. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, or text START, and we will start sending SMS messages to you again.

Help. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at (954) 851-4785.

Carrier Liability. Carriers are not liable for delayed or undelivered messages.

Message Frequency and Rates. Message and data rates may apply. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Privacy. If you have any questions regarding privacy, please read our privacy policy: https://floridaspringskayaking.com/privacy.

Age Restriction. You must be 18 years of age or older to use this SMS service. By opting in, you confirm that you are at least 18 years old.

Re-Enrollment. If you opt out and want to start receiving messages again, text START to the number that messaged you and we will resume sending you SMS messages. Standard message and data rates may apply.

Use of this website

You may use this website for lawful, personal purposes: planning a trip, booking a rental, and reading about the rivers. Do not misuse the site, scrape it in a way that harms the service, or attempt to interfere with booking or other guests.

The words, photographs, video, and design on this site belong to Florida Springs Kayaking or to the people we credit. You may not copy them for commercial use without permission. Some photographs are used under license; credits appear in the site footer.

Booking links open a FareHarbor checkout. FareHarbor’s terms also apply to the reservation you make there. This website is provided as-is. We work to keep it accurate, but trip details, hours, and availability can change; the booking page is the source for what you are buying.

Limitation of liability

To the fullest extent allowed by Florida law, Florida Springs Kayaking, its owners, and its staff are not liable for indirect, incidental, special, or consequential damages, or for loss of enjoyment, arising from your use of this website, a rental, or the SMS program. Our total liability for a booking will not exceed the amount you paid us for that booking. Some risks of paddling cannot be eliminated; you accept those risks when you launch.

You agree to indemnify Florida Springs Kayaking against claims that arise from your breach of these Terms, your misuse of equipment, or your failure to follow safety instructions or park rules, except to the extent caused by our own negligence or willful misconduct.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Courts in Florida have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect the brand or the site.

Changes

We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. The current version will always be posted at https://floridaspringskayaking.com/terms. Continued use of the site, a later booking, or a later SMS opt-in means you accept the updated Terms.
